These Terms govern your use of Cosmic Merge and its related purchases, advertising, progression, and online services.

Cosmic Merge is published and operated by Piercarlo Puccini Rodriguez under the Puccini Labs brand. Questions may be sent to hello@puccinilabs.com.

1. Acceptance and eligibility

By downloading, accessing, or using Cosmic Merge, you agree to these Terms. If you do not agree, do not use the game. The Privacy Policy explains how information is handled; it is a notice, not part of this agreement or a request for consent. If you are not old enough to agree to these Terms in your location, a parent or legal guardian must review them and authorize your use.

Cosmic Merge is a general-audience game and is not designed specifically for children or enrolled in Apple's Kids Category. Purchases require the authorization required by your Apple Account and device settings.

2. App Store license

Cosmic Merge is licensed, not sold. Subject to these Terms, you receive a limited, personal, non-exclusive, non-transferable, revocable license to install and use the game on Apple devices you own or control as permitted by the App Store rules.

Apple's Standard Licensed Application End User License Agreement also applies. If a mandatory App Store term or consumer-protection law conflicts with these Terms, the mandatory provision controls.

3. Gameplay and availability

Cosmic Merge is an entertainment game involving physics, scoring, progression, achievements, daily rewards, and optional powerups. Features, balance, visuals, difficulty, rewards, and service availability may change as the game evolves. We do not guarantee a particular score, reward, ranking, uninterrupted session, or ongoing availability of every feature.

Some functions depend on network access, Apple services, Google advertising services, RevenueCat, PostHog, or Cloudflare. Temporary unavailability must not be treated as a promise of compensation, except where applicable law requires otherwise.

4. Advertising and Remove Ads

The free version may display fullscreen advertising at bounded gameplay opportunities. Cosmic Merge does not use banner ads or rewarded ads. Ads are supplied by Google AdMob and may be contextual, non-personalized, limited, or personalized depending on applicable law and your consent and tracking choices.

A valid lifetime Remove Ads entitlement suppresses third-party ad requests for Cosmic Merge while that entitlement is active and available to the app. It does not remove first-party notices, purchase information, legal notices, or service messages. If the entitlement is temporarily unavailable because Apple or RevenueCat cannot be reached, the app will use its verified cached state where supported and provide restore or recovery options.

5. Purchases, powerups, and virtual items

Optional in-app purchases may include Remove Ads, consumable powerup packs, or bundles. Prices and currency are shown by the App Store before purchase. Apple processes payment, taxes, authorization, receipts, cancellations, and eligible refunds. We do not receive your payment-card details.

Powerups, inventory, rewards, and other virtual items are licensed game features. They have no cash value, cannot be transferred or exchanged outside the game, and are consumed according to the gameplay action you confirm. Except where required by law or App Store policy, consumed virtual items are not refundable. Do not buy a powerup unless you understand its displayed effect and quantity.

Use Restore Purchases for eligible non-consumable purchases. Because consumable inventory is reconciled through accountless commerce services, recovery may require network access and the Apple Account originally associated with the transaction. Support may request the app's random Support/Operations identifier to investigate a purchase or inventory issue; never send us your Apple password or payment-card details.

6. Daily rewards, achievements, and Game Center

Daily rewards and achievement grants are subject to eligibility, timing, versioned schedules, anti-duplication controls, and service availability. Device-clock changes, time-zone changes, offline use, interrupted operations, or fraud checks may delay eligibility but do not create a right to duplicate rewards.

Game Center achievements and leaderboards are operated by Apple and also subject to Apple's terms. Rankings and reports may be delayed, rejected, reset, or removed by Apple or by reasonable integrity controls. Local gameplay and rewards do not depend on falsifying or manipulating a public leaderboard.

7. Acceptable use

You must not:

Use Cosmic Merge for unlawful, fraudulent, or abusive purposes.
Exploit bugs, automate play, falsify scores, duplicate rewards, or manipulate purchases or advertising.
Reverse engineer, modify, redistribute, sell, lease, or sublicense the game except where applicable law expressly permits it.
Interfere with the app, its providers, security controls, networks, leaderboards, or other players.
Use another person's Apple Account, purchase entitlement, or support identifier without authorization.

8. Ownership

Cosmic Merge, including its software, original artwork, interface, game design, text, audio arrangement, trademarks, and related materials, is owned by the publisher or used under license. These Terms do not transfer ownership or grant rights to use Puccini Labs or Cosmic Merge branding outside normal use of the game.

Third-party frameworks, services, audio, fonts, or other licensed materials remain owned by their respective rights holders and may be subject to separate licenses or terms shown in the app's credits.

9. Privacy and third-party services

The Privacy Policy describes the information handled by Cosmic Merge and its providers. Apple, Google, RevenueCat, PostHog, and Cloudflare operate their respective services under their own terms and policies. We are not responsible for a third-party service beyond the responsibilities that applicable law places on us.

10. Suspension and termination

You may stop using Cosmic Merge at any time by deleting the app. Deleting the app does not automatically cancel or refund a completed App Store transaction and may not erase purchase records needed for restoration, legal compliance, or fraud prevention.

We may restrict online services, leaderboard participation, support actions, or accountless commerce operations when reasonably necessary to investigate fraud, protect the game or other users, comply with law, or address a material breach of these Terms. Mandatory consumer rights remain unaffected.

11. Disclaimers and limitation of liability

To the maximum extent permitted by law, Cosmic Merge is provided “as is” and “as available,” without warranties of uninterrupted operation, error-free physics, permanent feature availability, or fitness for a particular purpose. Nothing in these Terms excludes warranties or remedies that cannot legally be excluded.

To the maximum extent permitted by law, the publisher is not liable for indirect, incidental, special, consequential, or punitive losses, loss of data, lost opportunity, or loss caused by unauthorized device or account use. Any limitation applies only to the extent permitted in your jurisdiction and does not limit liability that cannot legally be limited.

12. Changes, law, and contact

We may update these Terms when the game, services, or legal requirements change. The effective date above will be updated, and material changes will be communicated through an appropriate app or store notice when required. Continued use after an update takes effect constitutes acceptance only to the extent permitted by law.

Applicable law governs these Terms without removing mandatory consumer protections or rights available where you live. If any provision is unenforceable, the remaining provisions continue to the extent permitted by law.
